These Terms of Use and Sale ("Terms") constitute a legally-binding agreement between Go Care Box, Inc. d/b/a Cozy Curves ("Cozy Curves," "Company," "we," "us," or "our") and you (whether personally or on behalf of an entity, collectively "you" or "your") regarding your access to and use of www.cozycurves.com and any other website, application, or service provided by us (collectively, the "Services").
By accessing or using our Services, you agree to be bound by these Terms, which contain liability limitations, arbitration clauses, and disclaimers, among other key provisions. IF YOU DO NOT AGREE TO ALL TERMS, DO NOT USE THE SERVICES.

1. GENERAL
1.1 Eligibility: You must be 18 years or older, or have parental consent, to use the Services. If you are under 18, you may only use the Services under the supervision of a parent or guardian. Parents or guardians are responsible for minors using the Services.
1.2 Use License: We grant a limited, non-transferable, non-commercial license to access our Services. You may not modify, reproduce, or exploit our Content without express written permission.
1.3 Third-Party Services: We operate on platforms like Shopify and utilize services like Stripe, PayPal, and Afterpay. Your use of these services is subject to their terms.
1.4 Modifications: We may revise these Terms at any time. Continued use of the Services after changes are posted constitutes your acceptance.
1.5 International Users: Our Services and products are intended for customers in the United States. Accessing our Services from outside the United States is at your own risk, and you are responsible for compliance with your local laws.
1.6 Electronic Communications: By using our Services, you consent to receiving communications electronically. These include order updates, account notifications, and marketing messages where legally permitted.
1.7 Scope of Services: Cozy Curves may alter, suspend, or discontinue the Services at any time for any reason without notice. The Services may periodically become unavailable due to maintenance or technical issues.
2. PRODUCTS AND SALES
2.1 Product Nature: Cozy Curves offers women's apparel, footwear, bags, hats, accessories, and custom-printed apparel, fulfilled through third-party suppliers and print-on-demand partners. Product descriptions, images, and availability are subject to change without notice.
2.2 Product Variations: Because our apparel is produced by multiple suppliers, slight variations in color, fit, sizing, and fabric may occur between items, and screen colors may differ slightly from the actual product. Please review size guides and product details before ordering. For custom-printed items, minor variations in print placement are a normal characteristic of the printing process and are not considered defects.
2.3 Care and Use: Please follow the care instructions on each garment. Cozy Curves is not liable for damage resulting from improper washing, wear, or failure to follow product care guidance.
2.4 Returns & Refunds: Return and refund eligibility is described in our Return & Refund Policy, which is incorporated into these Terms by reference. Certain items, including custom-printed products, are final sale except where they arrive damaged or defective.
2.5 Shipping: We ship within the United States and U.S. territories only. Items in a single order may ship separately from different warehouses, and processing and delivery times vary by item. Full details are in our Shipping Policy.
2.6 Product Availability and Pricing: Prices and product availability are subject to change. We reserve the right to limit or cancel orders at our discretion.
2.7 Product Accuracy: While we strive for accuracy, Cozy Curves does not guarantee that all product descriptions or images are free from errors.
2.8 Payment: We accept payments via third-party services. You authorize us to charge your chosen payment method and agree to keep it up to date.
2.9 Taxes: You are responsible for all applicable taxes related to your purchase.
2.10 Damaged or Incomplete Shipments: If a product arrives damaged or your order is incomplete, notify us at Support@cozycurves.com within the timeframe stated in our Return & Refund Policy. We will determine whether to issue a replacement or refund in accordance with that Policy.
2.11 Personal Use Only: Products are for personal use only. You may not resell or distribute products purchased from us.
3. ACCOUNTS AND DATA
3.1 Account Creation: You may create an account for faster checkout and tracking. You are responsible for safeguarding your login credentials.
3.2 Data Collection: We collect personal data in accordance with our Privacy Policy. We may use your data for order fulfillment, analytics, marketing (with consent), and customer support.
3.3 Cookies and Tracking: We use cookies and similar technologies for user experience and marketing. By using the site, you consent to this tracking.
3.4 Mobile Communications: By providing your phone number, you consent to receiving SMS messages, which may be marketing or service-related. Message and data rates may apply. Reply STOP to opt out.
4. PROHIBITED USES

5. INTELLECTUAL PROPERTY
All website content and branding are owned by Cozy Curves or its licensors. Unauthorized use is prohibited. You may not copy, reproduce, or distribute any content without prior written consent.
6. DISCLAIMER OF WARRANTIES
Products and Services are provided "AS IS." We disclaim all express and implied warranties to the fullest extent permitted by law. We do not guarantee that Services will be error-free or uninterrupted. You assume full responsibility for the use and selection of products.
7. LIMITATION OF LIABILITY
To the fullest extent permitted by law, Cozy Curves shall not be liable for indirect, incidental, or consequential damages. Our total liability shall not exceed the amount you paid for the affected product or $100, whichever is lower.
8. INDEMNIFICATION
You agree to indemnify and hold harmless Cozy Curves and its affiliates against claims, damages, and losses arising from your use of the Services, violation of these Terms, or misuse of products.
9. DISPUTE RESOLUTION
9.1 Governing Law: These Terms are governed by the laws of the State of Connecticut.
9.2 Binding Arbitration: You agree that disputes will be resolved through binding arbitration, conducted in Fairfield County, Connecticut, and not in court, unless you opt out within 30 days of accepting these Terms.
9.3 Class Action Waiver: You agree not to participate in class actions or class-wide arbitration.
9.4 Small Claims: Either party may bring eligible claims in small claims court in Fairfield County, Connecticut.
9.5 Limitation Period: Any claims must be filed within one year of the cause of action or be permanently barred.

11. MISCELLANEOUS
11.1 Force Majeure: We are not liable for delays or failures caused by circumstances beyond our control.
11.2 Entire Agreement: These Terms, together with our Shipping Policy, Return & Refund Policy, and Privacy Policy, constitute the full agreement between you and us.
11.3 Severability: If any part of these Terms is found unenforceable, the rest will remain in effect.
11.4 No Waiver: Failure to enforce any part of these Terms is not a waiver of our right to enforce it later.
11.5 Assignment: You may not assign your rights under these Terms without our consent.
11.6 Survival: Sections that logically should survive termination of these Terms will survive, including Disclaimers, Limitations of Liability, and Indemnity.
11.7 Notice: Notices may be provided via email, our website, or other electronic means. By using the Services, you consent to receive such notices electronically.
11.8 Language: These Terms are provided in English. Translations may be available but are for convenience only.
